Article 1 - Company

Couture Lin is a department of Saneco S.A.S (société par actions simplifiée/simplified joint stock company) whose registered office is located at  231 rue Dufour 59850 Nieppe, registered in the Dunkirk Trade and Companies Register under the number 382 560 092 00027, APE code 4676Z, intracommunity VAT: FR 53 382 560 092.


Article 2 - Subject

These general terms and conditions are concluded between Couture Lin, the vendor, and the purchaser. The purchaser hereby declares having the full legal capacity to commit in respect of these General Terms and Conditions of Sale. The purchaser hereby declares having examined them and accepts the rights and obligations related thereto. Any duly validated order on the www.couturelin.com site implies full adhesion and without any reserve as to these general terms and conditions of sale and, possibly, to any particular or specific conditions related to one or more products or orders. The purchaser is advised to save and/or print these general terms and conditions without, in any case, modifying them. Couture Lin reserves the right to modify or adapt these general terms and conditions without prior notice. In the case of modification, the conditions applicable shall be those in effect on the date of making the order. The date of update is shown at the top of these general terms and conditions.

For individual, the prices are shown in pounds sterling inclusive of all taxes including VAT and excluding delivery costs, for which the purchaser is responsible, with the exception of any particular indications or conditions.


Article 3 - Price

For professionals, the prices are shown in pounds sterling excluding taxes, and excluding VAT, and excluding delivery costs, for which the purchaser remains responsible, with the exception of any particular indications or conditions.

Shipping costs are calculated based on the delivery address indicated by the purchaser.

The prices shown take account of the VAT applicable on the date of invoicing. If the rate is modified, these changes may be applied to the price of items without the purchaser being notified thereof in advance.

The invoice is issued with the VAT rate applicable on the date of invoicing. If the rate is modified, these changes may be applied to the prices of items.

The total amount of VAT (on the products and delivery costs) is displayed when the order is summarised.

Couture Lin reserves the right to modify its prices at any time. The products will be invoiced on the basis of the tariffs in effect at the time of ordering.

However, the purchaser may be subject to the application of customs duties, depending on the country. The amount of these duties vary from one country to another and cannot be defined in advance by Couture Lin. These duties are the purchaser's responsibility and should be paid on receipt of the package of Products. Couture Lin cannot be held liable in the case of non-declaration and non-payment of customs duties and taxes due to the authorities of the country of delivery. As the legislation varies from one country to another, it is the purchaser's responsibility to inquire and undertake the obligatory steps to pay the taxes related to their order.


Article 4 - Unit and minimum purchase quantity

The products sold on the Internet site are sold by linear metre or by unit.

In the context of products sold by the linear metre, the minimum purchase is 1 metre.  Above 1 metre, it is possible to order by strip of 10 centimetres.

For professionals, a degressive tariff applies based on the quantity purchased

-          From 1 to 9 quantities ordered of the same product purchased, the price remains the base price applied.

-          From 10 to 29 quantities ordered of the same product purchased, the purchaser will benefit from a reduction of 30% on the unit price, excluding taxes, of this product.

-          For more than 30 quantities ordered of the same product purchased, the purchaser will benefit from a reduction of 50% on the unit price, excluding taxes, of this product.


Article 5 - Samples

COUTURE LIN offers to all customers the possibility to order samples free of charge. These samples are approximately 10 x 10 cm (dimensions not contractual). Thanks to this service, you can check the quality of our products and the colour you need. Consequently, we will send you only one sample by color and up to 6 colors. Over 6 samples, COUTURE LIN will contact you to know your exact needs and will propose you an adapted offer. If we do not receive your answer within one week, COUTURE LIN reserves the right to cancel your order of free samples.


Article 6 – Order

Purchasers select the product(s) they want to order on the site, indicating the quantities required and selecting the sizes options where necessary. Once the selection is finalised, they validate the order.

Purchasers must be conscious that every screen may display the colours differently. Samples may be ordered for more clarity.

To make an order, customers must:
- Creates their account or connect if they have one,  
- Select their product(s) by clicking on the photograph,
- Specify the quantity required,
-Click on the link "Add to basket",
- Click on "See my basket",
- Click on "Confirm order".
- Couturelin reserves the right to refuse orders with incomplete information

Purchasers choose whether they want to order as an invitee (in this case they must re-enter the invoicing and delivery addresses when they next order) or by creating an account by choosing a password and notifying their title, name, first name, postal delivery address and invoicing address if different from the delivery address. Purchaser will receive a confirmation of opening their account, in their mailbox.

To access the professional space, and avail of the special tariffs, purchasers must create an account by choosing a password and notifying their e-mail address, the name, first name, company name, invoicing address, the Siret number and VAT number. After verification of this information, the purchaser will receive a confirmation in their mailbox confirming access to the professional site.

Purchasers must indicate the method of payment chosen from the options offered on the website.

COUTURE LIN will acknowledge receipt of the order, as soon as it is validated, by sending an e-mail.

In certain cases, particularly payment default, erroneous address or other problem with the purchaser's account. COUTURE LIN reserves the right to block the purchaser's order until the problem is resolved.

In the case where an ordered product is unavailable, the purchaser will be informed by e-mail. It is possible that the debit may, nevertheless, be made. In this case, Couture Lin undertakes to reimburse the amount of the unavailable item within 48 hours (working days).

In the absence of proof to the contrary, the data recorded by Couture Lin constitute the proof of all the transactions.

Article 7 - Method of payment

- Online via the BNP PARIBAS bank Mercanet secure payment portal. The online payment can be made either by bank card (Carte Bleue, Visa or Mastercard) based on the purchaser's choice.

- By Paypal if you have an account or by bank card on the Paypal portal

- By bank transfer to the following contact details with the order number as the description: (Bank: BNP PARIBAS Lille - RIB (bank account identification details): 30004 02323 00011273745 78 - BIC (bank identifier code) : BNPAFRPP). In the case of non-receipt of the transfer within 10 days of the date of validation of the order, the order will be automatically cancelled

-  with Couture Lin vouchers in the form of a Discount Code. Discount Codes cannot be accumulated, the purchaser may only use one per order.


Article 8 - Delivery details

Couture Lin undertakes to prepare your order within 3 working days from the confirmation by the service provider of receipt of the order

The means of delivery shall be chosen by Couture Lin based on the volume and the location of delivery of the order.

The products will be delivered to the delivery address indicated by the purchaser. He/she will receive a link, by e-mail, to monitor the order as soon as it is dispatched.

The products can be delivered to the following countries:

Zone A : France Métropolitaine, Corse 

Zone B : Allemagne, Belgique, Espagne, Grande Bretagne, Italie, Luxembourg, Man (île), Pays-Bas, Madère, Portugal, Suède, Autriche, Finlande, Grèce, Irlande.    

Zone C : Bulgarie, Chypre, Estonie, Hongrie, Lettonie, Lituanie, Malte, Pologne, Roumanie, Slovaquie, Slovénie, République Tchèque, Liechtenstein, Norvège, Saint-Marin, Suisse, Vatican, Martinique, Mayotte (île), Réunion, St Martin, Saint Pierre et Miquelon, Canada, Etats-Unis, Guadeloupe, Guyane Française.

Zone D : Afrique du sud, Algérie, Canaries, Chine, Corée du Sud, Egypte, Hong Kong, Inde, Indonésie, Japon, Malaisie, Maroc, Mexique, Taïwan, Thaïlande, Timor oriental, Tunisie, Turquie, Albanie, Arménie, Biélorussie, Croatie, Géorgie, Macédoine, Moldavie, Monténégro, Russie, Serbie, Ukraine.

Zone E : Australie, Nouvelle Zélande.


Article 9 - Delay in delivery / loss of package / Package damaged

The transport operators were specifically chosen by Couture Lin as they offer a reliable service. However, there may be a delay in delivery or the product may get lost. In the case of non-receipt of the package 7 days after the order, the purchaser is bound to notify us of this delay by sending us an e-mail through our contact form or to contact@couturelin.com.

On receipt of the non-delivery notification, Couture Lin will contact the transport operator to start an investigation. An investigation of the transport operator may continue up to 21 days with effect from the date of the start of the investigation. If, during this period, the product is found, it will be immediately re-delivered to the purchaser's domicile.

If, on the other hand, the product is not found on completion of the investigation, the package shall be considered as lost, and Couture Lin will re-send the product(s) in question at its cost. If the product or products ordered are no longer available at this time, Couture Lin will reimburse the amount for the products lost. The exchange or reimbursement of items shall only be effective after the investigation of the postal services.

In any case, if deadlines were agreed, these shall be extended in the case of force majeure.

Force majeure consists, in particular, of the total or partial stoppage of the vendor's personnel or that of one of its suppliers, subcontractors or transport operators due to strike, ice, fire, storm, flood, manufacturing accident, machine or tool breakage, supply difficulties, lack of raw materials, etc.

The purchaser is bound to verify the condition of the product on delivery. Where necessary any damage to the product must be notified in writing to the transport operator on acknowledgement of receipt of the package and to Couture Lin by e-mail through our contact form to  contact@couturelin.com within 14 days of the date of receipt.

Any claim not made within the rules defined above and within the deadlines specified cannot be taken into account and shall release Couture Lin from any liability with regard to the consumer


Article 10 - Guarantee

The products sold on the site benefit from a contractual guarantee of 1 year with effect from their delivery.

The guarantee is limited to the repair, replacement or a reimbursement of the value of the products acknowledged as being defective by the vendor.

The guarantee only applies:

-          after acknowledgement of the defectiveness of products by the vendor

-          on condition that customers have not interfered with the products themselves or through a third party since their delivery

In general the guarantee cannot be implemented in the case of normal wear of the merchandise, damage caused as a result of incorrect use or usage that does not comply with the rules and precautions for use set out in the notice, incorrect maintenance, negligence, incorrect handling or installation, transformation of the products, etc.

Any return is subject to the prior agreement of the vendor shall always at the customer's cost. Any return must include a copy of the invoice, the delivery docket and a note setting out the reasons in detail.

Independently of this contractual guarantee, the vendor remains bound by defects of conformity of the goods and latent defects under the conditions provided for in Articles 1641 and 1649 of the Civil Code.


Article 1641

The vendor is bound to the guarantee due to latent defects in the item sold that makes it improper for the use for which it is intended, or where it diminishes this use such that the purchaser would not have acquired it, or would only have given a lower price, if they had known.

Article 1648 Al. 1er

The action resulting from redhibitory defects must be taken by the acquirer within a period of two years from discovery of the defect.


Article L211-4

The vendor is bound to deliver a good in compliance with the contract and respond to conformity defects existing on delivery.

It must also respond to conformity defects resulting from the packaging, the fitting or installation instructions when it is responsible for this under the contract or was carried out under its responsibility.

 Article L211-5

To conform to the contract, the good must:

1º Be appropriate for the normal use expected from a similar good and, where necessary:

-          correspond to the description given by the vendor and possess the qualities it presented to the purchaser in the form of a sample or model;

-          present the qualities that a purchaser may legitimately expect having regard to the public declarations publiques made by the vendor, by the producer or by its representative, in particular in the publicity or labelling;

2º Or present the characteristics defined by common accord by the parties or be appropriate for every special use sought by the purchaser, brought to the knowledge of the vendor and the latter accepted.

Article L211-12

The action resulting from the defect in conformity is prescribed after two years with effect from the delivery of the good.


Article 10 - Right of withdrawal/exchange policy

The purchaser has a right of withdrawal of 30 days to return the products to use without having to justify the reason. This period runs from the receipt of the merchandise.

In this return the purchaser is bound to specify the date and number of the order, the reference(s) of the product being returned.  

Couture Lin will propose to the purchaser either to exchange the product, or obtain a voucher for the equivalent amount to the article being exchanged (excluding delivery costs), or to be reimbursed. Any reimbursement will be made by us within 30 days of the date of receipt of the return by crediting the bank card used by the purchaser or in the case of failure by cheque sent to the invoicing address.

To best satisfy you, any exchange is still possible within 15 days of delivery of the order.

The exchange, issue of a voucher or reimbursement shall occur when the following conditions are met:

1. Couture Lin will have acknowledged receipt of the merchandise returned by the purchaser at their cost.

2. The procedures described above are complied with by the purchaser.

3. The merchandise was returned to it in its initial condition, and was not used or damaged.

In the case of an error in the sending of the merchandise, the return costs shall be met by Couture Lin.

If there was no error in the order, the transport costs associated with the exchange shall be shared between the purchaser and the vendor: the purchaser shall be responsible for the cost of returning the item to Couture Lin, the vendor shall be responsible for the costs of re-sending the product.


Article 11 - Protection of personal and individual information

         Personal Data:  

The information collected will be the subject data processing aimed at the collection of information. The COUTURE LIN department of SANECO is the recipient of this data.

It will be used to respond as effectively as possible to the different services offered by the Couture Lin website and may be transmitted for commercial purposes to its partners who market the products and services related to the linen sector.

In accordance with the "informatique et libertés" (Information technology and civil liberties) Law no. 78-17 of 6 January 1978 amended in 2004 in relation information technology, files and cicil liberties, you can object to this transmission for legitimate reasons and exercise your rights of access and rectification of your personal data.

You can exercise this right and obtain communiction of your personal data by sending a letter to COUTURE LIN by e-mail to contact@couturelin.com.

If you have subscribed to the information services by e-mail (" the  Newsletter") you can request tht you no longer receive these letters either as indicated above, or by following the instructions set out at the end of each of these letters, when you reveice them.

Article 13 - Liability

For all the stages of access to the site, consultation, completing forms, making orders, delivery of items or any other service. Couture Lin only has a best endeavours obligation.

As a consequence, the liability of Couture Lin cannot be committed for all the inconvenience or damages inherent in the use of the Internet network and completely outside the diligence and precautions taken by our company.

In particular, any disruption in the provision of service, or any exterior intrusion or presence of an information technology virus shall not commit the liability of Couture Lin.

Article 14 - Photos

The photographs on the Internet site are not contractual. They are presented on an indicative basis and cannnot ensure perfect similarity with the product offered, in particular as regards the colours and the texture of the textiles.

Article 15 - Applicable Law/Litigation

THese general terms and conditions of sale are subject to French Lw. The applicable language is French.
